сокр NLRBНезависимое федеральное ведомство [ independent agency]; создано по закону Вагнера [ Wagner Act] в 1935 для рассмотрения жалоб профсоюзов и рабочих на действия предпринимателей [unfair-labor-practice complaints] и принятия соответствующих мер. Управление было наделено правом издавать обязательные для исполнения распоряжения и проводить выборы представителей рабочих для ведения переговоров о заключении коллективных договоров [ collective bargaining agreement]. Поправки к закону Вагнера [ Taft-Hartley Act, Landrum-Griffin Act] расширили полномочия управления. Ныне его основной задачей является контроль за соблюдением коллективных договоров с участием предпринимателей и профсоюзов и предотвращение дискриминации при найме, нарушающей гражданские права. Имеет право выносить распоряжения типа "прекратить и воздерживаться впредь" [ cease and desist]. Является квазисудебным органом, неподчинение постановлениям которого может повлечь наказание. 18 Taft-Hartley Labor Act
док.эк. тр., юр., амер. закон "О трудовых отношениях" Тафта-Хартли, 1947 г. (является дополнением к закону Вагнера, 1935 г.; отменил некоторые положения закона Норриса-Ла Гардия, 1932 г.; фактически представлял собой ограничение прав трудящихся, расширенных указанными законодательными актами в период "нового курса" президента Ф. Рузвельта; поставил контроль за трудовыми спорами на новую юридическую основу, расширив функции Национального управления по вопросам трудовых отношений; установил, что профсоюз и работодатель до того, как разорвать коллективный договор, должны предупредить об этом противную сторону и служащий посредником между ними государственный орган; последний имеет право в 80-дневный срок вынести постановление, запрещающее любую забастовку в случае, если он сочтет ее угрожающей национальному благосостоянию и безопасности; закон также запретил некоторые виды забастовок, лишил законодательной защиты участников незаконных забастовок; запретил систему "закрытых цехов", однако разрешил такую систему, при которой руководство предприятия по соглашению с профсоюзом может принимать на работу нечленов профсоюза только при условии, что они вступят в профсоюз в течение тридцати дней, если за эту систему проголосует большинство работников предприятия; ограничил деятельность коммунистов в рядах профсоюзов; запретил профсоюзам участвовать в политических кампаниях; в настоящее время данный закон исполняется с учетом закона "О трудовых отношениях" Лэндрама-Гриффина 1959 г., который внес изменения и дополнения в его наиболее архаические и антитрудовые положения)Syn:See:Англо-русский экономический словарь > Taft-Hartley Labor Act
